Wash Club Terms of Agreement

These Wash Club Terms of Agreement (“Terms”) form a binding agreement between you (“Member”, “you”, “your”) and Hang 5 Carwash (“we”, “us”, “our”).

1. ACCEPTANCE & AGREEMENT

By purchasing, activating, or using a Wash Club Membership, you confirm that you have read, understood and agreed to these Terms and the Car Wash Conditions of Entry available at www.hang5carwash.com.au.

Ongoing use of the Membership constitutes continued acceptance of these Terms.

2. MEMBERSHIP OVERVIEW

The Wash Club is a recurring subscription service providing ongoing access to car wash services for registered vehicle(s) at the nominated Hang 5 Carwash location.

Membership may be offered on:

  • A monthly recurring billing basis; or
  • An annual recurring billing basis,

as selected at the time of purchase.

Membership provides access to services. It does not guarantee usage, minimum washes, queue priority, or specific cleaning outcomes.

Failure to use the Membership does not pause, suspend, reduce or invalidate recurring charges.

3. MEMBERSHIP INCLUSIONS

An active Membership entitles each registered vehicle to:

  • Unlimited car washes during normal operating hours;
  • Complimentary self-serve vacuum use, where available.

All services are subject to:

  • Site availability;
  • Queue capacity;
  • Posted site rules;
  • Operational and safety conditions.

Membership benefits:

  • Have no cash value;
  • Do not accumulate if unused;
  • Are access-based services, not fixed quantities of washes.

4. VEHICLE REGISTRATION, LPR & ADDITIONAL VEHICLES

Membership access is managed using a Licence Plate Recognition (LPR) system.

Each Membership includes one registered licence plate unless otherwise specified.

Additional vehicles may be added for an additional recurring fee per vehicle.

Each additional vehicle:

  • Is treated as a separate Membership entitlement;
  • Is billed on a recurring basis (monthly or annual, as applicable);
  • Receives its own unlimited wash access and complimentary vacuum use.

Members must ensure licence plate details remain accurate and current.

Access may be denied where the detected licence plate does not match registered records.

5. ACCOUNT ACCURACY & CARDHOLDER AUTHORITY

By enrolling, you confirm that:

  • You are the authorised cardholder or have authority to use the nominated payment method;
  • All information provided is true, accurate and complete.

Members must maintain current licence plate, contact and payment information.

Hang 5 Carwash is not responsible for charges resulting from inaccurate or outdated information.

6. RECURRING BILLING AUTHORISATION

By completing sign-up, you expressly authorise Hang 5 Carwash and its payment processors to:

  • Charge your nominated payment method at the start of each billing cycle;
  • Automatically renew your Membership at the selected billing interval (monthly or annual) unless cancelled in accordance with Clause 8;
  • Use updated card details provided by your card issuer or payment network (including updated expiry dates or replacement card numbers);
  • Re-attempt declined or failed payments.

You acknowledge that this is a recurring subscription transaction and that charges will automatically continue at the selected billing interval until cancellation is successfully completed in accordance with Clause 8.

Charges will appear on your bank or card statement under the descriptor “HANG 5 CARWASH” or a substantially similar trading name.

A temporary verification transaction may occur when adding or updating a payment method.

System records, transaction logs and billing records constitute evidence of recurring authorisation.

Members are responsible for monitoring their billing date and reviewing account statements to ensure charges are accurate.

7. BILLING CYCLES

7.1 Monthly Memberships

Monthly Memberships are billed every 30 days from the original sign-up date and automatically renew unless cancelled.

Where practicable, Hang 5 Carwash may issue a renewal reminder prior to monthly renewal. Failure to receive a renewal reminder does not affect the Member's responsibility to cancel prior to renewal in accordance with Clause 8.

7.2 Annual Memberships

Annual Memberships are billed in advance on a recurring 12-month cycle.

Annual Memberships:

  • Automatically renew every 12 months unless cancelled prior to renewal;
  • Remain active for the full 12-month term once billed;
  • May be cancelled at any time via the Manage Membership Portal;
  • Are non-refundable in whole or in part for any unused portion of the annual term, except where required under Australian Consumer Law.

Where practicable, Hang 5 Carwash may issue a renewal reminder prior to annual renewal. Failure to receive a renewal reminder does not affect the Member's responsibility to cancel prior to renewal in accordance with Clause 8.

Failure to use the Membership does not suspend, pause or reduce billing.

8. CANCELLATION (STRICT PORTAL REQUIREMENT)

Cancellation must be completed via the official Manage Membership Portal before the next billing date.

Cancellation must be successfully completed before 11:59pm (AEST) on the day immediately preceding the renewal date.

Cancellation is only effective once the cancellation process has been successfully completed within the Membership Portal and a cancellation confirmation has been issued.

A cancellation confirmation screen and/or confirmation email (where provided) constitutes proof of cancellation. Members should retain confirmation records for their files.

The following do not constitute cancellation:

  • Email;
  • SMS;
  • Social media messages;
  • Verbal requests to staff;
  • Requests made in person to staff at the car wash site;
  • Notification to customer support (except for reporting a verified technical fault as set out below);
  • Bank disputes or chargebacks.

Hang 5 Carwash staff at site locations are not authorised to process, action, confirm or accept Membership cancellations. Any request made to staff in person does not constitute cancellation and will not prevent renewal unless cancellation is completed through the Membership Portal in accordance with this Clause. Members should not rely on verbal statements from staff regarding cancellation status.

If a Member experiences a genuine technical issue preventing access to the Membership Portal, the Member must notify customer support immediately and prior to the renewal date by emailing contact@hang5carwash.com.au.

The Member must provide:

  • A clear written explanation of the issue being experienced;
  • Where reasonably available, a screenshot or image evidencing the error.

Email notification is accepted solely for the purpose of reporting a verified technical issue and does not constitute cancellation unless a system fault is confirmed in accordance with this Clause.

Notification of a technical issue does not in itself constitute cancellation.

Where a verified system error is confirmed by Hang 5 Carwash, cancellation will be processed effective from the date the issue was first reported, provided the Member contacted us prior to renewal.

Where no system fault is identified and the Portal remains accessible, the Member remains responsible for completing cancellation through the Membership Portal before renewal.

Cancellation requests submitted after a renewal charge has been processed will take effect from the next billing cycle and will not operate retrospectively.

Members are responsible for ensuring cancellation is completed prior to billing and are encouraged to retain cancellation confirmation for their records.

Cancellation prevents future billing only. Membership access continues until the end of the current billing period.

9. CHARGEBACKS & DISPUTED TRANSACTIONS

Initiating a chargeback or payment dispute does not constitute cancellation of a Membership.

Members remain responsible for valid charges incurred prior to cancellation in accordance with these Terms.

Hang 5 Carwash will reasonably investigate any billing dispute raised by a Member and review system records, access logs and payment history before responding to the payment provider.

Where a recurring transaction is disputed while the Membership remains active, we may suspend access pending investigation to prevent further charges.

Reactivation may require resolution of outstanding amounts.

10. SERVICE AVAILABILITY

Wash Club services may be temporarily unavailable due to maintenance, equipment faults, weather conditions, power or internet outages, public holidays, government directives, or other operational reasons.

Temporary interruptions or closures do not constitute breach of contract and do not entitle Members to refunds, credits, extensions or compensation except where required under Australian Consumer Law.

11. NO GUARANTEED ACCESS OR WAIT TIMES

Membership provides access to services but does not guarantee entry at any specific time.

Wait times may vary based on demand, queue volume and operational conditions.

12. EVIDENCE & RECORDS

Our electronic records, including:

  • LPR logs;
  • Transaction records;
  • Membership system data;
  • Payment processor confirmations,

constitute evidence of service availability, access and billing activity.

System-generated confirmations and transaction records are deemed accurate in the absence of manifest error.

13. MISUSE & ENFORCEMENT

The following are prohibited:

  • Licence plate manipulation or swapping;
  • Use by unregistered vehicles;
  • Circumventing LPR systems;
  • Fraudulent, abusive or unsafe conduct.

We may suspend or terminate Membership where misuse, sharing, fraud or breach of these Terms is identified, acting reasonably in the circumstances.

14. CONDITIONS OF ENTRY

All vehicles using the Wash Club must comply with the Car Wash Conditions of Entry.

Failure to comply may result in refusal of service without refund.

15. NO REFUND AFTER BILLING

Once a billing period has commenced, Membership fees are non-refundable except:

  • Where required under Australian Consumer Law;
  • Under Clause 16 (Limited Goodwill Refund).

Failure to use the Membership does not create entitlement to refund, credit or suspension of billing.

16. LIMITED GOODWILL REFUND (DISCRETIONARY)

Hang 5 Carwash may, at its sole and absolute discretion, consider a goodwill refund of the most recent renewal payment only.

Any goodwill refund will only be considered where:

  • A written request is submitted within 7 days of the most recent renewal;
  • No washes were redeemed during that renewal period;
  • The original payment method remains valid and capable of receiving a refund.

Any goodwill refund:

  • Is not an entitlement or contractual right;
  • Does not constitute an admission of liability;
  • Does not create precedent;
  • Does not waive or limit any rights or obligations under Australian Consumer Law.

Hang 5 Carwash reserves the right to decline any goodwill refund request at its discretion.

17. LIMITATION OF LIABILITY

Nothing in these Terms excludes, restricts or modifies rights under the Australian Consumer Law.

To the fullest extent permitted by law:

  • Hang 5 Carwash is not liable for indirect, consequential or economic loss;
  • Where liability cannot be excluded, it is limited to re-supply of the services or the cost of re-supply, at our discretion.

18. AUSTRALIAN CONSUMER LAW

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot be excluded under the Australian Consumer Law (“ACL”).

Under the ACL, services must be provided with due care and skill and must be reasonably fit for their disclosed purpose.

If the services supplied under a Membership suffer a “major failure” (as defined in the ACL), you are entitled to:

  • Cancel the service contract; and
  • Receive a refund for the unused portion of the Membership; or
  • Seek compensation for any reasonably foreseeable loss or damage resulting from the failure.

If the failure does not amount to a major failure, Hang 5 Carwash is entitled to remedy the failure within a reasonable time by:

  • Re-supplying the services; or
  • Rectifying the issue.

A failure is not a “major failure” merely because:

  • A Member does not use the Membership;
  • Wait times vary;
  • Services are temporarily unavailable due to maintenance, operational, weather, safety, public holiday or similar interruptions;
  • Access is refused due to non-compliance with the Conditions of Entry;
  • A Member elects to cancel during a billing period.

Whether a failure constitutes a “major failure” is determined in accordance with the Australian Consumer Law and not solely by a Member's subjective dissatisfaction.

19. ELECTRONIC COMMUNICATIONS

You consent to receiving all Membership communications electronically, including billing confirmations, renewal notices, payment updates, pricing changes and service updates.

You are responsible for maintaining current contact details.

20. CUSTOMER SUPPORT COMMUNICATIONS

Information provided by staff or customer support is general assistance only and does not override these Terms.

In the event of inconsistency, these Terms prevail.

21. INTERNAL DISPUTE RESOLUTION

Members may contact Hang 5 Carwash to raise concerns regarding billing or Membership issues.

We aim to respond within a reasonable timeframe and seek to resolve matters fairly and efficiently before escalation to external dispute bodies.

Nothing in this clause limits your rights under the Australian Consumer Law.

22. ASSIGNMENT

Hang 5 Carwash may assign or transfer its rights and obligations under these Terms as part of a sale, restructure or business transfer.

Your rights will not be adversely affected by such assignment.

23. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

24. GOVERNING LAW

These Terms are governed by the laws of Queensland, Australia.

The parties submit to the non-exclusive jurisdiction of the courts of Queensland.

25. CHANGES TO TERMS & PRICING

Hang 5 Carwash may update these Terms or adjust Membership pricing from time to time to reflect operational improvements, cost changes, market conditions, legal requirements or service enhancements.

Where a change is material and likely to adversely affect Members, reasonable advance notice will be provided.

If you do not agree with a material change, you may cancel your Membership prior to the change taking effect in accordance with Clause 8.

Price changes apply from the next renewal date and will not apply retrospectively.

Continued use of the Membership after changes take effect constitutes acceptance of the updated Terms.

Failure to receive notice due to outdated contact information does not invalidate a change.
